GENERAL PROVISIONS

§1 Subject of the Regulations

  1. The SAVENTIC website, available at: saventiccare.com, is operated by the Saventic Health, headquartered in Toruń at ul. W. Łokietka 5, 87-100 Toruń, registered under numbers: NIP 8792707617, REGON 381859490, KRS 0000758906
  2. SAVENTIC contact details are as follows:

  3. These regulations define the terms of use of the Website.

§2 Definitions

  1. SAVENTIC – Saventic Health with its registered office in Toruń at ul. W. Łokietka 5, 87-100 Toruń, Poland, registered under numbers: NIP 8792707617, REGON 381859490, KRS 0000758906
  2. User – any natural person who uses the Website.
  3. Website – the online service made available to Users at the address: saventiccare.com, operated by SAVENTIC.
  4. Patient – a User using the Website, whose data is processed through one of the forms available on the Website; due to the fact that SAVENTIC does not provide medical services, the Patient as referred to in these Terms is not considered a patient within the meaning of the applicable law.
  5. Terms – these Terms of Use of the Website.
  6. Rare diseases – medical conditions that occur in fewer than 5 out of 10,000 members of a given population.
  7. SAVENTIC Coordinator – a person appointed by SAVENTIC whose task is to collect additional data or verify data submitted by the Patient via the form in order to fully utilize the functionalities of the Website.
  8. Feedback – information provided to the Patient containing guidance on potential directions for further diagnosis, including possible recommendations of a specialist or medical center the Patient can contact.
  9. Anonymization – the process of transforming personal data in such a way that it cannot be attributed to an identified or identifiable individual.
  10. Anonymized Data Recipient – an entity personally or financially affiliated with SAVENTIC.
  11. Preliminary Form – a functionality available on the Website that allows the Patient to provide certain health-related and contact data for the purpose of receiving a preliminary analysis of the likelihood of having a rare disease.
  12. Detailed Form – a functionality available on the Website that allows the Patient to provide additional health-related data in order to receive Feedback, after previously submitting contact information and answering several questions in the Preliminary Form.

§3 Minimum Technical Requirements

  1. To use the Website, the following minimum technical requirements must be met:

    a) a computer with Internet access and a recommended operating system of Windows 10 or macOS 10.10, or a minimum operating system of Windows 7, or a mobile device with Android or iOS;

    b) an installed internet browser that supports JavaScript and cookies:

    • Microsoft Edge version 85 or higher
    • Mozilla Firefox version 70 or higher
    • Google Chrome version 70 or higher
    • Opera version 70 or higher
    • Safari version 14 or higher

     

  2. To use the Application, in addition to meeting the above requirements, you must have an active email account.
  3. To properly download the Feedback, software capable of opening and editing PDF files is required.
  4. To ensure the secure use of the Application and data transmission, the Website Provider implements adequate measures, particularly technical ones, appropriate to the level of risk—especially measures preventing unauthorized access to and modification of personal data transmitted over the Internet, including the use of the SSL (Secure Socket Layer) protocol.

CONTROL AND PREVENTION OF ILLEGAL CONTENT

  1. SAVENTIC informs that while using the Website, the data entered by the User is temporarily stored in the browser’s cache memory. This functionality is known as “caching.” The data stored in this manner is not visible to SAVENTIC unless the User completes and submits at least the Preliminary Form to SAVENTIC.
  2. Given that the Website allows Users to input various content into text fields within the forms and upload files—both during the Detailed Form completion and ongoing communication with SAVENTIC—SAVENTIC is obliged to monitor for illegal content and, when appropriate, report it to law enforcement authorities or remove it. Users are responsible for the content they provide to SAVENTIC. Uploading unlawful content, including material that infringes copyrights, privacy rights, or any third-party rights, is strictly prohibited.
  3. This content control may involve both automated tools and manual review by SAVENTIC personnel.
  4. If SAVENTIC decides to remove certain content, the User who provided the content will be informed of the reasons for this action and the available appeal.
  5. The complaint review mechanism mentioned above allows Users to object to SAVENTIC’s decision by presenting their position on the matter. The objection should be submitted within 14 days of receiving the decision. Based on the objection, SAVENTIC may either revise or uphold its decision, providing objective reasons for the outcome.
  6. For operations conducted within the territory of the European Economic Area (EEA), SAVENTIC hereby establishes a contact point for direct electronic communication with the competent authorities of Member States, the European Commission, and the Digital Services Board for the purposes of Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services and amending Directive 2000/31/EC (Digital Services Act) (Text with EEA relevance).   7. The above email address also serves as a contact point for Users residing in the EEA in matters related to the provisions of this section.

FINAL PROVISIONS

  1. The following attachments form an integral part of the Terms and Conditions:
    a) Terms of Use for SAVENTIC Forms;
  2. The Terms and Conditions are available free of charge on the Website in the “Terms and Conditions” section at: https://.saventiccare.com/terms-conditions/as well as at the SAVENTIC headquarters. The Terms and Conditions are provided on the Website in a form that allows users to access, reproduce, and save their content using commonly available functions accessible to the User.
  3. SAVENTIC reserves the right to amend the Terms and Conditions for legal or organizational reasons. Users will be informed about any changes to the Terms and Conditions by the publication of the new, revised version on the Website at: saventiccare.com
  4. Amendments to the Terms and Conditions come into effect on the day the new version is published or on the date indicated in the notice regarding the changes.

Appendix No. 1

TERMS OF USE FOR SAVENTIC FORMS

§1 General Information

  1. The form is a feature included on the Website.
  2. The Website serves the following purposes:
    a) Providing guidance on the possibilities/directions for further diagnostics regarding Rare Diseases;
    b) Supporting Patients in finding the appropriate specialist or medical center specialized in suspected Rare Diseases;
    c) Developing innovative technologies to support the diagnosis of Rare Diseases, including algorithms;
    d) Promoting health and disease prevention, including increasing knowledge and awareness among Patients about Rare Diseases.
  3. Use of the forms available on the Website by the User is completely free of charge. A Patient may only be a person who, according to the law of their place of residence, has at least limited legal capacity. If the applicable law requires consent from a legal guardian or representative to use the Website, such consent must be obtained.
  4. A User who is not a Patient and does not have a legal basis to represent the Patient may not provide that Patient’s personal data while using the Website.

§2 How the Forms Work

  1. Access to the forms can be obtained through the Website via the “REPORT A CASE” link or through a “push-up” notification on the homepage or subpages of the Website, i.e., using the “GO TO FORM” link.
  2. The Patient’s personal data is entered by the User in two stages: via the Preliminary Form and the Detailed Form. Filling out each form by the User is entirely voluntary.
  3. Each form consists of fillable fields or selectable answers/options. Some fields concern contact information, while others relate to health data.
  4. Fields marked with a red asterisk “*” are required fields for using the solution. All other fields are optional.
  5. To obtain the most accurate and in-depth Feedback Information, it is recommended to provide truthful data and, where possible, fill out the optional fields concerning the Patient.
  6. Initially, the User fills out the Preliminary Form, where, in addition to some general health information about the Patient, they are asked to provide contact information. After receiving the submitted Preliminary Form, SAVENTIC uses the provided contact details to contact the User or Patient (depending on whose data was given) to present a probability analysis of the presence of a rare disease. If the probability is indicated, the User will be invited to complete the Detailed Form. If no such probability is found or it is low, the User will still have the opportunity to use the Detailed Form.
  7. The Detailed Form is intended to gather detailed data about the Patient, including the option to upload scans of medical documentation. The data collected at this stage are forwarded to doctors who, supported by an artificial intelligence tool, prepare the Feedback Information.
  8. Filling out at least the Preliminary Form enables SAVENTIC to contact the User regarding form functionality.
  9. Form Sections and Data Categories Include:

    a) Symptom Map:

    i. mandatory
    ● Information on whether the Patient experiences the symptom, including medical or genetic data based on affirmative answers;

    ii. optional
    ● Information on symptoms that are not experienced by the Patient (a closed list of non-occurring symptoms);

    b) Basic Medical Data:

    i. mandatory
    ● age;
    ● biological sex;
    ● height;
    ● weight;
    ● description of the Patient’s symptoms;
    ● description of tests performed for an undiagnosed condition;

    ii. optional
    ● diagnosed conditions;
    ● description of family history of diseases, including genetic conditions;
    ● description of current treatment, including medications taken;
    ● specialists previously consulted;

    c) Contact Data:

    i. mandatory
    ● email address of the Patient/User;
    ● country/region/city of residence;
    ● patient’s phone number;
    ● postal code;

    ii. optional
    ● patient’s first name;
    ● patient’s last name;

    d) Medical Documentation and Consents:

    i. mandatory
    ● consent to the processing of Patient’s/User’s personal data by SAVENTIC
    information on how the Patient/User learned about SAVENTIC

    ii. optional
    ● uploading files by the Patient, including medical records

  10. Due to ongoing efforts to improve the functioning of the Website, the data that the User is asked to provide does not have to be entered in the order described above. In order to obtain specific types of information (e.g., regarding previously diagnosed conditions), SAVENTIC may prepare one or more questions or checkboxes for the User to complete.
  11. To submit each form to SAVENTIC, it is necessary to confirm the form by clicking the “SAVE AND SUBMIT” link after completing it.
  12. Once at least the Preliminary Form has been registered by SAVENTIC, there is a possibility that a SAVENTIC Coordinator may wish to contact the Patient or the User, if they are properly authorized to represent the Patient, in order to clarify the information provided in the form or, if necessary, to request additional information or supporting documentation, as well as to follow up on diagnostic progress. For such contact to be possible, the User must first consent (on their own behalf or on behalf of the Patient) to telephone or email communication by checking the appropriate box in the Preliminary Form.
  13. The data provided by the User in the forms is submitted to SAVENTIC, which then forwards it for expert analysis to SAVENTIC specialists in order to prepare Feedback Information for the User.
  14. The feedback and other guidance provided to Users using the Website do not constitute medical advice, healthcare services, or any other medical service. They are for informational purposes only and must not be treated as specialized medical advice, diagnosis, or treatment recommendations. In particular, they should not replace professional medical tests or consultations. SAVENTIC shall not be held responsible for any actions or omissions taken by Patients as a result of the feedback provided, including discontinuation of previously initiated diagnostics or treatment, or changing healthcare providers. All feedback received should be consulted with a physician.
  15. After the entire process is completed, the Patient’s or User’s data may be deleted or anonymized. Once anonymized, the data may be transferred to the Anonymized Data Recipient for the further development of algorithms aimed at assisting in the diagnosis of Rare Diseases.

§3 Data Provided via the Website and Personal Data Protection

  1. The controller of the data provided by the User through the use of the Website is the Saventic Health, headquartered in Toruń at ul. W. Łokietka 5, 87-100 Toruń, registered under numbers: NIP 8792707617, REGON 381859490, KRS 0000758906
  2. The personal data collected by SAVENTIC is processed in accordance with the Privacy Policy, available at: saventiccare.com/privacy-policy
  3. SAVENTIC is authorized to provide the User with information regarding the functioning of the Website, after the User has given consent. This information relates to the current operation of the Website and its new features. Such information does not constitute a commercial offer and is not intended to promote the activities, services, or business of SAVENTIC or its partners, but rather serves as a tool for the development and operation of the Website. Information may be delivered via the User’s email address or phone number provided during form submission.
  4. Detailed provisions regarding the protection of personal data and the privacy policy can be found in the Privacy Policy, available on the Website in the “Privacy Policy” section at: saventiccare.com/privacy-policy

§4 Final Provisions

  1. This regulation is an integral part of the Website’s Terms of Use.
  2. Terms written with capital letters have the same meaning as defined in the Website’s Terms of Use or Privacy Policy.
